Copyright or Not?

We have been asked the following question numerous times “Do I need to register my program’s copyright?”

Answer

Wondering how many pirated copies of your software are used?
For every 1 purchased copy of a software, there are about 15- 150 illegal registrations (use cracked registration keys). Many companies use your software for years without paying.  We found one company that used 25 copies of our software without paying a penny.

ZTE found guilty for piracy of EDA software
June 14, 2011

China’s ZTE Corp. was found liable for illegally access and use software marketed by high-frequency EDA vendor AWR Corp. a National Instruments company.

The “phone home” feature of EDA software helped the U.S. District Court for the Central District of California find that ZTE employees had accepted AWR’s click-through license agreement. A hearing on AWR’s remaining claims and on damages is set to begin Aug. 9.

Software piracy has become a major source of concern for EDA vendors, particularly in China,
where intellectual property laws are not respected by many individuals and businesses.

"Piracy is a huge problem for EDA and other engineering software providers around the world," said Kathryn Kranen, vice chairman of the EDA Consortium, in a statement issued by AWR. "Piracy hurts paying customers by distorting their competitive playing fields. EDA Consortium members, including AWR, have an active program to assure that our customers benefit from elimination of software piracy."

Why is it difficult to pursue software pirates?

  • Copyright attorneys charge a fee of $300-450 per hour (sometimes more) to pursue infringement of your software.

  • Very few copyright attorneys have any experience with shareware copyright cases.  You will be paying $300/hour for them to learn how to pursue your cases.

  • Companies generally ignore software developers' complaints.

  • They challenge your data and claim that the data is not valid.

On Piracy
by Nick Bradbury

Many people who use pirated products justify it by claiming they're only stealing from rich mega-corporations that screw their customers, but this conveniently overlooks the fact that the people who are hurt the most by piracy are people like me.

Shareware developers are losing enormous amounts of money to piracy, and we're mostly helpless to do anything about it. We can't afford to sue everyone who steals from us, let alone track down people in countries such as Russia who host web sites offering pirated versions of our work. If you visit a few public "warez" sites, you're unlikely to find software from companies such as Microsoft who can afford to prosecute pirates - instead you'll find hundreds of shareware products written by people like me.  Read more On Piracy
